2832.0. "I'm famous! ;^)" by MIZZOU::SHERMAN (ECADSR::Sherman DTN 223-3326) Wed Jan 22 1992 13:12

Hey, guys! Check out the latest Disc Makers catalog! On page 41 they
feature a letterhead package and guess whose letterhead they decided to
use as an example! :) I can even read my name on the picture of the
    business card!

    Congratulations.

Can they do that? Do they owe you money? Can you sue?

They don't owe me money. Sure, they didn't ask my permission. But, I
really don't mind and they did do a good job on it. I'm really pleased
with the results and I get lots of nice comments about my card.

Had the same thing happen with my wedding video. It came out real nice.
A few months later, the guy had a booth at a local mall for a bridal
expo and there it was - he was demoing my wedding video as an example
of his best work. Not much I could do, but it was good to know he
hadn't done any work he felt was better.

Whether you can do anything or not depends on the fine print in
    your contract with him.

2832.6your stuff is copyrighted the moment you make itRTOEU::CLEIGHKeine AhnungWed Jan 22 1992 15:407
Steve, your stuff is protected by copyright law so there
may be a case (like Paul said, you need to check any
contracts you have), but I wouldn't worry about it, as
you need to make friends in this business, not alienate
them

Hey steve, can you scan in your card and letterhead
so that we can see it too?

In case there was any mistake, my "can you sue?" comment was entirely
    tongue in cheek...

Heck, I wouldn't sue! I like the folks at Disc Makers and plan on
continuing to do business with them. Also, my logo is one of those that
can be easily recognized once you've seen it. It'll be all over my
cassette. Who knows? That alone might get some sales. :)

    I don't have a scanner or I'd scan it in for y'all. But, I'll pack a
card with every cassette I (personally) send out. Such a deal! :)

And, no, my album isn't out yet. I'll yell all over the place when it
is. Gee, ain't you proud just to know me? ;^)

2832.10any advertising is good advertisingCSC32::M_VEGAFri Feb 21 1992 16:0414

From a photography standpoint, if Disc Makers is selling the photo/
layout whatever and making money directly from sale of the picture,
you may have some grounds for a stance (depending on wording of your
contract with them), but it sounds like they are using the material as
advertising to display their service. You could ask that it not be
displayed out in the open (street window...) for public viewing, but
merchants can still keep the material in an album for discretionary
viewing by clients interested in examples of their work.

In either event, it sounds like you are getting good advertising
    through their advertising.

In all honesty, Steve's logo is pretty small.. I couldn't read the
    address or anything..

Maybe Steve ought ta sue cause the pics too small for customers
to get a really good look at the quality service they provide.

    Ain't it Amarka...?
