                SPECIAL REPORT:  "GOVERNMENT PARANOIA"

      (a look at Montana's Code 45-8-105 "Criminal Syndicalism")

EDITOR'S NOTE:  Many in various FidoNet, USENET, and INTERNET
conferences are now aware of the government assault upon the Militia
of Montana, much of which has already been shown to be fallacious and
malicious allegations without foundation.  It was enough however to
land seven men in jail, with combined bails set at close to one
million dollars!  One of the state statues used to arraign these men
was a "catch all" law called "Criminal Syndicalism".  Many responded
to Liberty Northwest from across the nation asking what this law was.
The name "Syndicalism" many pointed out, was not even in the
dictionary!

Many states have loosely defined laws on the books, regarding this
and similar matters that makes every citizen a state felon, a
criminal, and whenever a state decides to prosecute, no one is
either safe, or secure, from such loosely defined statutes.

Below is a look at Montana's version of a catch all statute that is
now at the centre of the controversy.  This file, and related

            P O L I T I C A L   S Y N D I C A L I S M

                    Montana Code:  45-8-105

Here is the exact text of the above code, as written ;

  45-8-105.  Criminal syndicalism.

  (1) "Criminal syndicalism" means the advocacy of crime, malicious
damage or injury to property, violence, or other unlawful methods of
terrorism as a means of accomplishing industrial or political ends.

  (2) A person commits the offense of criminal syndicalism if he
purposely or knowingly:

      (a) orally or by means of writing, advocates or promotes the
doctrine of criminal syndicalism;
      (b) organizes or becomes a member of any assembly, group, or
organization which he knows is advocating or promoting the doctrine
of criminal syndicalism; or
      (c) for or on behalf of another whose purpose is to advocate
or promote the doctrine of criminal syndicalism, distributes, sells,
publishes, or publicly displays and writing advocating or advertising
such doctrine.

  (3) A person convicted of the offense of criminal syndicalism shall
be imprisoned in the state prison for a term not to exceed 10 years.

  (4) Whoever, being the owner or in possession or control of any
premises knowingly permits any assemblage of persons to use such
premises for the purpose of advocating or promoting the doctrine of
criminal syndicalism shall be fined not to exceed $500 or imprisoned
in the county jail for a term not to exceed 6 months, or both.

It should be noted by the casual observer, that "Political
syndicalism" is a crime that any one could be readily found guilty
of, including those who are "skeptical" concerning various actions
or authority of the state or federal governments.

In the cases involving the seven men jailed in Montana, the definition
was never clearly defined to correspond with particular actions of the
seven men in question.  Did the Montana produce tapes, video, booklets,
and other materials critical of various government actions?  Yes.

Did the Militia on Montana hold meetings throughout the State of
Montana and adjoining states that criticized various government
activities and laws?  Yes.

Did MOM leaders speak at other meetings and functions in which the
content of the speech criticized various elements and activities of
the federal government?  Yes.

None of these activities however advocated violence, the overthrow of
the government, sedition or other unlawful means of injury to property,
private or public, or the act of terrorism against government agents
or private individuals.

Note especially that anyone who falls under the statute in terms of
allowing to be published (orally or in writing) advocating
Criminal (Political?) Syndicalism is also guilty of the offense.

Has it come down to the point in America today, when political
questions arise, that those critical, skeptical, or in disagreement
with the existing political character of government programmes and
actions, can be landed in jail?  The answer to that questions is
unfortunately, Yes.

We now appear to be witnessing a clamp down on the free flow of ideas,
and the right of free speech, to redress injustice in government,
and the defense of liberty, property and life under the provisions
of the Bill of Rights to the U.S. Constitution.  New federal laws,
including the recent proposed Senate Bill to restrict the content of
electronic/BBS/Network media, are a blatant attempt by some within
our government to enforce at gun point, "Political correctness".

The moral of the story is, if you disagree with the government, you
should keep it to yourself.  Don't hold meetings.  Don't write
critical commentary, or allow someone else to do so if you are a
part of the media.  No dissent.  No rocking the boat to a New World
Order. Stay within the "approved" guidelines or risk prison time.
And, more frighteningly, don't defend your rights of free speech,
the right to keep and bear arms, the right to assembly, or, in
some cases, the right of religious freedom.  Do do so could also
land you a fine and a stiff prison term.

Is this the message Americans want to hear from their state and
national authorities?  Certainly not.  We are presently experiencing
perhaps the greatest clamp-down in American history against the basic
freedoms upon which the foundations of this nation was built.  You
don't have to agree with the propositions of the Patriot Movement,
the Militia of Montana, or other similar groups to understand that it
is YOUR freedom, YOUR liberty, YOUR right of assembly and self
expression, and YOUR right of conscience to know something is wrong
here.  Dreadfully wrong.

On this issue, all of us are essentially in the same boat.  Whether
we define ourselves as Liberal or Conservative, Republican or
Democrat, middle of the road, or within a minority "fringe" group,
America as we have known it is changing its foundation.  Liberty and
Freedom are no longer the centrepiece of American society.  Laws
and statutes are being created as fast as the printing presses will
churn them out, and in most cases, these laws restrict our freedom
and liberty to live our lives in peace without government
interference.

Government rules by the consent of the people.  When enough Americans
no longer consent to the rape and pillage of their substance and
liberty, this nonsense will stop.  Until that time, we can expect
these outrageous and tyrannical actions to grow and continue to
imprison Americans.

    Most of us in here could be arrested on such loosely defined laws. 
    This is blatantly unconstitutional and is a rape of the First
    Amendment.
    
    I would be lying if I said I was at all surprised that such laws exist,

    By the way... for all I've said in support of the GOP, at
    the time this law was enacted, the legislature was controlled
    by the Repubs and the governor was a Repub.

    First I ever heard of it.  Aside from the obvious unconstitutionality,
    there are several other interesting points :
    
    The name is gobbledygook !  "criminal syndicalism" indeed.
    
    And what really is the intent ?  The crime of foobar shall consist
    of advocating foobar.  But isn't this circular ?

    according to Chambers, syndicalism is "a development of trade-unionism    
    which originated in France, aiming at putting the means of production

    This is how they do it.  First, Syndicalism is illegal.  Then
