    Has anyone heard anything about a new law in regards to carrying
    a sidearm while bow hunting ? This is for the state of N.H.
    A friend haerd something about prohibiting them even with a permit.
    Probably just a rumor.

    	I called N.H. Fish and Game and asked them that very question.
    	There reply was that it was perfectly legal, just be sure you
    	are using it legally!!

    	A couple of weeks ago I took a bow hunter safety course and
    asked the game warden teaching the game law part of the course that
    same question. Not only can you carry it during bow season but you
    can supposedly use it on small game if they're in season. You can
    also carry and use a sidearm in shotgun only territory so long as
    you don't use it on deer. I too thought the reasoning behind this
    was as clear as mud.
    	One other thing. In N.H. you can carry a loaded sidearm just
    about anywhere without any permit so long as it is in CLEAR VIEW.
    The only exception to the above is you cannot carry a loaded firearm
    into an establishment that sells alchohol.

    It should also be mentioned that without a permit you cannot legally
    carry a loaded sidearm in or on any motor vehicle in the state of
    N.H. nor in any courtroom.
    
    I bowhunt during the bucks only rifle season with a side arm.  I
    figure that with the bow a doe is a legal target but if I happen
    upon a buck I have a higher level of confidence with the .44.  
    
    Ray, I figure that they are refering to rim-fire side arms for use
    in shotgun territory???  Am I correct in this assumption?

    	The game warden did not specifically say a rimfire pistol. He
    also (indirectly of course) agreed that the law didn't make any
    sense. Also, would it matter ? In other words, can you use a rimfire
    rifle in shotgun only territory for taking other than deer ?
    
    	I am disappointed with a few things this year. Licenses have gone
    up, federal duck stamps went up, fabric licenses (and deer tags)
    changed to cheap paper ones, and the hunting guide format was shrunk
    in size and content. Maybe it was me but it also seems that there
    weren't enough duck stamps made to easily go around. I don't have
    a problem with the increases in licenses/stamps to help maintain
    the sport for future generations. I'd like to think that the money
    taken in is well spent but I appear to be paying more and getting
    less. I guess the point of this is to ask if a financial statement
    of incoming/outgoing funds is readily available ?

 Took a look around in here for any explaination of the new "tree stand 
permission" law in New Hampshire this year and couldn't find anything.

 I called Fish and Game in Concord, (603-271-3421) and permission forms are
on their way to me. The woman I talked with said it is ok to make copies
of the original, (it is a 2 sided form) because you need a seperate 
permission form filled out and signed *by the land owner* for each tree stand 
you plan on using.

 I didn't ask her all the questions I wanted to, but instead asked that she 
send the F&G laws book along too which she said she would so I'll try to
enter the text of the new law as soon as possible after I get it.

 Does anyone else have and info on this new "law" ?? Yesterday was the first 
I had heard of it???

    	I am planning on using a "Loggy Bayou" tree stand in N.H.
    	(Loggy's do not have spikes that go into the tree) and
        I do not plan on cutting any limbs.
    
     	As I interpret the new law, I beleive I will not require a
    	consent form. Do you agree with the way I interpreted the
    	Law?

 I don't know George. I sure hope not cause I use a Loggy too and that's why 
I'm concerned.

 Like I said, yesterday was the first I heard about this law and the guy that 
told me about it said "any kind of tree stand" you needed permission. 

 That's why I decided to call Fish and Game. I want the straight story. :-)

    NH new Treestand Regulations:
    
    Effective July 19, 1991, NH now requires written permission from the
    landowner to build, use or erect treestands, observation blinds, and
    pit blinds, on a particular property.  Here are the highlights of the
    new regulations (RSA 207:36-a).
    
    Express written permission from the land owner or designee is now
    required for the following: to insert into the tree any metallic;
    ceramic, or other-type object used as part of a ladder or observation
    deck; to cut any tree in connection with the activities relative to
    treestands or blinds.
    
    the permitee must carry this permit on his person while in the field,
    and he shall be subject to inspection  on demand of any conservation
    officer.  All property permits shall expire on the December 31 each
    year.  Any person violating any provision of the new regulation shall
    be  guilty  of a violation and will be held liable for the amount of
    damage caused by the act, to be recovered by the property owner
    sustaining the damage.
    
    Existing treestands, observation blinds and pit blinds are not
    grandfathered under the new regulation so permission is required for
    these also.

Fra covered it pretty well but for those interested, here is the exact text.

 		STATUTE relative to the regulation of tree stands, 
	 		observation blinds and pit blinds.

 	RSA 207:36-a

 I. No person shall erect, build or use a tree stand or observation blind on 
    land of another person that damages or destroys a tree by inserting into 
    the tree any metallic, ceramic, or other object used as part of a ladder or 
    observation deck, without express written permission from the property 
    owner or designee.

 II. No person shall erect, build or use a pit blind on land of another person 
     without express written permission from the property owner or designee.

 III. No person shall cut any tree in connection with any of the activities 
      regulated under this section without express written permission of the 
      proprty owner or designee.

 IV. The permitee shall carry such permit on his person while in the field 
     and shall be subject to inspection on demand of any conservation officer.

 V.  All property owner permits shall expire on December 31 of each year 
     unless rescinded by the property owner or designee.

 VI. Any person who violates any provision of this section shall be guilty of 
     a violation and shall be liable for the amount of damage caused by the 
     act, to be recovered by the property owner sustaining the damage.

 VII. The executive director shall adopt rules persuant to RSA 541-A, 
      relative to the form, issuance and filing of property owner permits for 
      the tree stands, observation blinds and pit blinds.

 By reading this, I don't think Loggy type stands need permits, but I'm not
going to take the chance. I'd rather have the permission slip and not need it 
than not have it and end up at the mercy of some game warden with an attitude 
and using his own particular interpretation to justify busting me.. :-)

 There were other interpretations of the above in the game laws/season dates
book so be advised to read them too just so you know what's going on.

 If you need permission slips, call NH Fish and Game in Concord, License 
Division at (603) 271-3421 and they'll send them right out.

    Well, now after reading yours it sounds like, as long as your treestand
    does no damage to the tree your ok. (section 1)
    
    If this is the case, even the Loggy does some damage to the tree due to
    the U-channel lock.

    So, a rope-on stand, with either rope-on climbing blocks or
    steps, or one of those new lightweight ladders, would be 
    exempt. Of course, you'll still need permission to clear
    shooting lanes.

    In NH is it illegal for someone (not hunting) to accompany a bow hunter
    in the woods? Gus Rinella and I were discussing my tagging along with
    him one day just for fun and we're not sure if I can legally do so
    or not.
