247.0. "ex-wife welfare support how??" by WFOV11::TORRES_JIMMY () Mon Feb 01 1993 12:00

I found out that the x is taking welfare I reported to the child
support/investigation office in the welfare dept. That I have 50%
physical custody. Is she intitle welfare support if I have 50% physical
custody and paying her child support? Does any body have any a clue what
going to happen now since I reported this to the welfare dept. Is this
in my best interst or hers.

What is going to happen is one of two things:

    1. The welfare office will ignore you.
    2. If you wrote to them and they have acknowledged your letter via
letter. Your off the hook if they decide to come after you to pay child
suport to her. Because you have informed them. Once these clowns get
the wheels going it takes a ICBM to stop them. And now you have steered
    them in the right direction.
    3. The office will pin a gold star on your chest and say what a brave
    lad you are. (NOT!) ;)
    4. The local papers will catch wind and will nominate you for
    president!:) (NOT!) ;)

Anyhow. Next is to sit back relax and let the crappie fall where it
may. And hopefully not on the end of you new wing tips.:)

    Peace

If anything, they are likely to come after you for an increase in
CS payments if the CS is not currently covering the Welfare payment.

She should not get welfare during the time you have the child with
you. If she has been, they may cut off here payments during the
time you have the child with you. They _could_ charge her with
fraud for collecting welfare when she is not entitled to it, but
    they probably won't.

247.6DOR TAKING ME TO COURT FOR MORE CSWFOV11::TORRES_JIMMYFri Mar 12 1993 12:4319
WELL IT WAS ON A TUESDAY I WENT TO MEET MY LAWYER AT COURT. WE TALK
ABOUT OUR GAME PLAN.YES THE EX SHOWS UP WITH A INDIVIDUAL POSSIBLY HER
LAWYER. WE WENT TO ASK IF HE WAS HER LAWYER HE SAID NO. HE IS FROM THE
DOR DEPARTMENT.(WELFARE) MY LAWYER TOLD HIM THAT WE ARE HERE TO STOP
PAYMENT ON THE AREARS ON THE EQUITY OF THE HOUSE THAT I SOLD.THE DOR
BELIEVED THAT I WAS PAYING $125 A WK ON CHILD SUPPORT BUT THAT WAS NOT
THE CASE. THE BOY WAS ALL LOST.. SO WAS SHE. NOW THE DOR IS TAKING ME BACK
TO COURT TO INCREASE MY CHILD SUPPORT PAYMENT.. NOW MY LAWYER TOLD THE
JUGDE THAT THE GUIDE LINES DOES NOT WORK WITH THIS CASE BECAUSE I HAVE
50% SHARE CUSTODY. NOW I AM PAYING 75.00 A WK. NOW EX IS HAVING FULL
BENIES I ASK THE DOR IF I QUAILIFY HE SAID I DO'NT THINK SO.NOW IF I
HAVE 50% SHARE CUSTODY AND I PAYING CHILD CARE OF 75.00 EVERY TWO WK
BESIDE THE 75.00 A WEEK EX IS GETTING WILL I HAVE TO PAY MORE? BECAUSE
THE DOR SAID SO OR WILL THE JUDGE TELL THEM TO TAKE A HIKE.OR SHOULD IT
    BE LESS?

    ANY GOOD SUGGUESTING OR IDEAS..

It will probably be up to the judge at this point. The "guidelines"
I've seen usually say that the payments of one party to antoher
in cases of shared custody also are determined by the amount of
actual time spent with each parent.

Hope you had a court recorder going during these little ditties. Cause
thats the Only way your going to have justice served. For if he decides
to outside the guidelines you can apeal. But if you have no court
recorder going and you have little or no evidence of the case, then you
    have no chance. Good luck.

Best thing to do at this point is pray big time. And get the tummy up
for a good fight back legally.
