    Hello,
    
    
    Help......................I reside in the state of
    California.  I am currently providing daycare for my
    Fiancee's son after school.  Approximately three months
    ago, the X-Wife was ordered by the court to pay $100.00
    a month in daycare pay, she has yet to pay any amount.  
    
    My Fiance shared with the X, that he planned on filing
    contemp charges. The X has informed by Fiance that an attorney 
    told her that she does not have to pay this court ordered 
    money, as I am not a licensed daycare provider.  I believe 
    that a person must be licensed if they are providing daycare
    for many children?  I provide care for my daughter and 
    his son.  
    
    Our attorney told us that I need to provide receipts 
    to my Fiance for the day that I am providing. 
    He did not say, that this woman is not responsible
    to pay me daycare expenses, as I am not licensed.  The 
    attorney did share, that if we were married it would be 
    another story, she may be able to get out of her 
    responsibilities.

    The details of the coart order are very important here. 
    If the order states she pays the money to be used at his disgresion
    then she must pay.
    From what you are saying she is challenging the "Quality of care" and
    is reserving her rights of payment only if licensed care is obtained.
    I'd bet a beer this woman doesn't hold you in very high regard! Get a
    few more details about the actual wording of the order.

    Probably need to determine exactly what the court orders provide for.
    Probably need to sit down with the attorney and determine *exactly*
    what the orders say and exactly where you stand legally.  Don't 
    know about Calif., but in Colorado you can provide daycare for up
    to X (don't know exact number right off) number of kids without
    being licensed.  Need to find out what California law provides.
    
    Can probably go to court and have her held in contempt or get a
    judgement against her, then (if you get a judgment) you can have
    the support taken out of her paycheck ( welcome to ERA ).
    
    BTW.  I got my first support check this week (took a picture of it :^))
    We'll see if they continue.
