123.0. "Complaint/Review a judge" by LUNER::MACKINNON () Fri Apr 26 1991 08:43

    Question

Does anyone know whether or not a process exists to have a judge
    reviewed?

    Background

NCDad has to spend one weekend with child in Mass and one weekend
with child in NY. NCDad has only one place he can stay in NY
with his child for the weekend he is supposed to be there.
It is at a home with an alcoholic. NCDad explained to judge that
he did not want to expose the child to this condition and would
he be allowed to have both weekend visitations to take place in
    Mass. Judge said no.

Clearly this judge is not educated as to the effects of alcoholism
on folks other than the alcoholic. Now I feel that this person
either should get educated or not be allowed to make decisions
    which pertain to such.

Is this being unrealistic? Should a complaint against said judge
be filed. The result of her actions are putting this child in
danger of physical and emotional abuse. NCDads other option is
not to see the child on the weekend he is supposed to have her
in NY. Clearly this is not an option in his point of view.

    Any suggestions?

    Michele,

About all you can do in this case is
    1) Appeal the case to a higher court if the laws of your state permit.
Some states won't allow "matters of judgement" to be appealed. Ie.
there is no specific law governing this decision, or the judge did
not violate any laws/rights/court-procedures. In any case there is
a time limit on filing an appeal.

    2) Campaign to have the judge removed from office the next time
       he/she comes up for reelection.
